How Does Chapter 13 Help?
Chapter 13 bankruptcy is informally called a restructuring bankruptcy. Unlike Chapter 7, Chapter 13 bankruptcy does not discharge their debts once the paperwork is complete. In Chapter 13, the debts are consolidated and restructured, and you are given a new payment plan.
The new payment plan will typically last five years, and once that is complete, the balance of the debts is discharged. However, that does not mean all the debt you’re facing will find a resolution. There are many debts that bankruptcy will not discharge.
Undischargeable Debts
The bankruptcy code holds explicitly that certain debts must be paid in full. Bankruptcy cannot discharge them. These include student loans, back child support, recent tax debt and other legally induced debts.
However, removing the pressure of your other debts can go a long way toward resolving those not impacted by bankruptcy.
